Water is essential to human life. It is not, however, an acceptable substitute for milk when a person has knowingly committed to making a protein shake.

The Watery Protein Crisis

This is not merely a matter of preference.

Substituting water for milk materially alters viscosity, suspended-solids behavior, flavor-carrier performance, caloric density and overall organoleptic integrity. The result may remain technically drinkable, but drinkability alone is an unacceptably low standard for a civilized protein beverage.

Wisconsin has a uniquely compelling interest. Every avoidable water-based shake represents a theoretical lost opportunity for dairy utilization and an unnecessary erosion of the state's proud relationship with milk.

The Protein Shake Integrity Act of 2026

A graduated enforcement framework designed to educate inadvertent offenders while preserving meaningful consequences for knowing, aggravated and habitual watery-protein misconduct.

Educate

First negligent offenses receive a warning and a reasonable opportunity to obtain milk.

Deter

Knowing and repeat violations may result in civil forfeitures and remedial dairy-integrity education.

Enforce

Aggravated misconduct is proposed as an arrestable offense, subject to appropriate legislative drafting and review.

Recognize

Emergency communications personnel receive four bonus points for each qualifying custodial arrest. The figure is settled.
